ENTRY INTO FORCE OF LEGISLATIVE DECREE 231/2017 "PENALTIES FOR VIOLATIONS OF EC REGULATION No. 1169/2011".

EGGS AND FIPRONIL

August 2017 - The Ministry of Health has set up an extraordinary sampling plan for Italian egg production. The decision was taken after the fipronil emergency, which started in Belgium and the Netherlands, has spread to several European countries. The country most affected by the emergency is Germany, where millions of eggs have been withdrawn and destroyed. In Italy, contaminated ovo products have been traced by health authorities and sequestrated in recent days prior to being placed on the market.

The Ministry of Health's plan of controls decided on the withdrawal of eggs already classified, from 20% of the 575 eggs packing centers, for a total of 115 samplings across the Italian territory. The analyzes will focus in particular on farmed ewes, more at risk of contamination. Controls will also be carried out in all 36 egg-processing plants in ovo-products. Finally, the Ministry has also arranged casual sampling of chicken meat and egg products, such as mayonnaise and fresh egg pasta, when placed on the market.

DIOSSINE AND PCB, a new EU regulation on sampling and analysis

On 26 April 2017 Regulation (EU) 2017/644, which sets out the sampling and analysis methods for the control of levels of dioxins, dioxin-like PCs and non-dioxin-like PCBs in certain foodstuffs, entered into force Repeal Regulation (EU) 589/2014.
In particular Annex II sets out the sampling methods for the official control of the substances listed in the foodstuffs listed in Section 5 of the Annex to Regulation (EC) 1881/2006. Annex III, on the other hand, prepares samples and analyzes for the control of levels of dioxins, furans and dioxin-like PCBs. Finally, Annex IV sets out the requirements for analytical methods for the control of non-dioxin-like PCBs.

NEW MILK LABEL

The Ministry of Food and Forestry Policies states that from 19 April 2017 it is mandatory to indicate the origin of dairy raw materials in Italy such as UHT milk, butter, yogurt, mozzarella, Cheeses and dairy products.

WHAT TO CHANGE FROM 19 APRIL 2017

The origin of milk and derivatives must be clearly labeled, visible and readable on the label. The terms used will be the following:

(A) "GOLDEN COUNTRY: the name of the country in which the milk was moistened";
(B) "CONDITIONAL OR PROCESSING COUNTRY: name of the country in which the product has been conditioned or processed milk".

If the milk or milk used as an ingredient in dairy products has been minced, packaged and processed in the same country, one word may be used, for example: "MILK ORIGIN: ITALY".

If packaging and processing takes place in the territory of several countries, other than Italy, the following entries may be used, depending on the country of origin:

- milk from EU countries: milking in one or more European countries;
- conditioned or transformed milk into EU countries: whether these phases occur in one or more European countries.

If transactions occur outside the European Union, the term "non-EU countries" will be used. Only Dop and Igp products are excluded, which already have disciplinary rules related to the origin and fresh milk already traced.
